Steps:
- Evictions will vary based upon state and local laws.
- Evictions will typically follow these steps:
- Eviction filed
- Court date and Judgement
- If granted eviction, tenant will have X amount of days to move out
- If tenant does not move out, a writ of possession must be filed with the court
- The constable/sheriff will come and post writ of possession
- If the tenant still does not move out, the constable/sheriff will need to be called again
- The constable/sheriff will come and remove tenant from property
- You will need to upload all notices, court documents and court decisions to the resident's documents in Entrata
- The court may give judgement on what rental amount they owe. You will only be able to charge that amount on the FMO
Eviction Status in Entrata
- Pull up Resident Ledger
- Click on More Actions
- Click on Enter Termination
- Enter Termination Type, Eviction Reason, and Eviction Start Date (the day you originally filed the eviction)
- The lease status will change to Current-Under Eviction & Do Not Allow Payments
- After court (when you are granted the eviction), go to More Actions > Enter Eviction Date
- Once the property gains possession, click Process Eviction under the Resident's quick view tab
- Move the person out & perform the FMO
You can manage evictions in the Dashboard under Residents > Evictions to keep up with them.
